Title: Right Of Way Threat
Description: Right of way

Spanish - March 29, 2010 12:20 PM (GMT)
Hi, I have heard that the right of way between Poutney Gardens to Lime Street via The Limes in Belle Vue is under threat of closure by a group of residents.

Does anyone know if this is true, and if so what can be done to protect it from closure?

Thanks

I thought this was all put to bed when the Limes gardens were developed?

Once a twenty year use has been established I don't think it is that easy to remove.
I was rather hoping that as the council are drawing to the end of this years budget they were considering putting a proper tidy access alongside Toronto terrace to this ROW.

Is it a legal public right of way or just a path which has been used for a long while? Because the latter can always be closed, whilst a proper right of way is almost impossible to close.

Im not too sure, the council website shows it as a public footpath, I plan to "walk" it tonight and see what the poster says

I've checked Shropmap and the route through The Limes is a public right of way. There would have to be quite a considerable process for it to be closed permanently.

There is a note on the gates in the Limes and Lime st, mentioning something about Map 14 and modifications exercise, didnt understand it fully, it says to speak with Clare Porter at the Sirehall for clarification objections etc

Once lost a public right of way can rarely if ever be brought back.

Why do the residents want it closed? If there are problems is it due to other factors, lack of policing, etc?

It hasn't been lost in fact SABC rather hoped to get rid of it prior to selling the Limes House and it's garden after Trading Standards moved out but were unable to do so due to it's popularity and continued usage.

I should imagine it affected the value of the site when it was sold but I think it is good that the development is not a private gated one as they are IMHO destructive to communities.
